“Non Alcoholic” beverages

The following halal wine website is making the rounds, it’s halal certified by some org in Spain. Can we get an official fatwa regarding this.

We have received your query dated 26/10/21, our response is as follows:

Before we mention the Shar’ee ruling on the wine in which the details are found in the above link , we would like to shed some light on the prohibition of alcohol in Islam : 

With regards to the prohibition of alcohol in the Noble Quran , Allah Ta’ala mentions ;

يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ 

“O you who have Imaan! Indeed liquor (wine, beer and other intoxicants), gambling, idols and (distribution by) arrows are filth (vile acts) from the acts of Shaytaan, so abstain from them so that you may be successful (gain salvation in both worlds”

(Surah Al-Maidah , Ayah 90)

We also see the prohibition of intoxicants found in the Ahadeeth of Rasoolullah Sallallahu Alayhi Wasallam coupled with the severity of drinking :

عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏”‏ كُلُّ مُخَمِّرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ وَمَنْ شَرِبَ مُسْكِرًا بُخِسَتْ صَلاَتُهُ أَرْبَعِينَ صَبَاحًا فَإِنْ تَابَ تَابَ اللَّهُ عَلَيْهِ فَإِنْ عَادَ الرَّابِعَةَ كَانَ حَقًّا عَلَى اللَّهِ أَنْ يَسْقِيَهُ مِنْ طِينَةِ الْخَبَالِ ‏”‏ ‏.‏ قِيلَ وَمَا طِينَةُ الْخَبَالِ يَا رَسُولَ اللَّهِ قَالَ ‏”‏ صَدِيدُ أَهْلِ النَّارِ وَمَنْ سَقَاهُ صَغِيرًا لاَ يَعْرِفُ حَلاَلَهُ مِنْ حَرَامِهِ كَانَ حَقًّا عَلَى اللَّهِ أَنْ يَسْقِيَهُ مِنْ طِينَةِ الْخَبَالِ

The Messenger of Allah () said: Every intoxicant is Khamr (wine) and every intoxicant is forbidden. If anyone drinks wine, Allah Ta’ala will not accept prayer from him for forty days, but if he repents, Allah Ta’ala will accept his repentance. If he repeats it a fourth time, than it is a Haq on Allah Ta’ala that He will give him Tinat al-Khabal to drink.  He was asked: What is Tinat al-Khabal, Messenger of Allah? He replied: Discharge of wounds i.e. pus, from the inhabitants of Hell. If anyone serves it to a minor who does not distinguish between the lawful and the unlawful, it is a Haq on Allah Ta’ala that He will give him to drink from the Tinat al-Khabal i.e. discharge of wounds i.e. pus, from the inhabitants of Hell.

عَنْ عَامِرِ بْنِ سَعْدٍ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم نَهَى عَنْ قَلِيلِ مَا أَسْكَرَ كَثِيرُهُ

The Messenger of Allah () forbade a small amount of whatever intoxicates in large amounts 

(Sunan An-Nasai)[2]

We learn from the above Ayah of the Noble Quran and the Ahadeeth of Rasoolullah Sallalahu Alayhi Wasallam that a Muslim must avoid alcohol at all costs , no matter the amount, if one fails to do so then this will lead to ones destruction in this world and in the hereafter.

As for the wine in the above link , based on our findings the wine will be impermissible as it still contains alcohol (albeit in a small quantity), we will quote verbatim from the website itself : 

“It wasn’t until more recently, through the use of modern technologies, that wines were finally able to be dealcoholized to 0.0% or less than 0.05% alcohol by volume. This innovation is what allows non-alcoholic wines to become Halal Certified”[1]

We clearly see from the above quote that the wine in question still contains alcohol , therefore it is Haraam and is just like any other alcohol on the market . [1]

Together with the above quotation we also find that the website mentions the procedure on how they achieve non-alcoholic beverages , the procedure is known as Dealcoholisation[1] , based on the aforementioned procedure the alcohol will still be Haraam as it contains alcohol , coupled with this is that we see time and again the website mentions :

“The drink contains 0.5% or less alcohol by volume”[2]

Based on our findings , the reason by volume is mentioned is because the wine still contains alcohol.[3]

Lastly, we would like to mention a few more points , as Muslims we have our own way of life , this way of life has been gifted to us by The Messenger of Allah (ﷺ) , the best of creations , therefore there is no need for a Muslim to follow alien ways when a Muslim has the best of ways , we also learn the following from the Hadeeth of Rasoolullah Sallalahu Alayhi Wasallam:

عَنْ ابْنِ عُمَرَ قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ تَشَبَّهَ بِقَوْمٍ فَهُوَ مِنْهُمْ

Whoever imitates (the ways) of a nation is from amongst them (Abu Dawood)

The appetite for Halal versions of Haram things are often linked to to a spiritual malady which requires to be cured. May Allah Ta’ala makes us from amongst those Muslims that love Islam and all the injunctions of Shariah, Ameen.

قَوْلُهُ وَبِهِ يُفْتَى) أَيْ بِقَوْلِ مُحَمَّدٍ، وَهُوَ قَوْلُ الْأَئِمَّةِ الثَّلَاثَةِ لِقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – «كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ» رَوَاهُ مُسْلِمٌ، وَقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – ” «مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ» رَوَاهُ أَحْمَدُ وَابْنُ مَاجَهْ وَالدَّارَقُطْنِيّ وَصَحَّحَهُ
