Halal slaughtering & Blood donation

I met you in the Mt Rokill mosque I was with South Africa Jamat.

Question Number 1: What is the ruling of a person who do not perform Juma Salaat?, the reason why I have this question is if a company (these companies export Halal Meat to Muslim countries) is not letting the Halal Slaughtermen to pray their Juma Salat (but they do allow the Halal Slaughtermen to Pray their Daily prayers).

Another Question on this topic: Tasmiyah should to be recited on each an every animal slaughtered or if the Halal Slaughterman is stand with the intention of doing Zeeba, if he recite on some animal all the animal slaughtered by him will be classed Halal (especially Chicken with is slaughtered up to the speed of 145 chickens per minute) so it is not possible in anyway that one Halal Slaugherman can recite Bismillah 145 time in a minute.

Question Number 2: As I have asked you regarding me donating my Blood (Sadaqa) to New Zealand Blood Service in return I do not get paid for it but sometimes they give some gift (for example pen, key tag or thermos cup), Donating approximately once every three months, because my blood group is required more than normal (but it is entirely up to me how much I want to give and whether I want to give or not). Every time I donation my blood it saves 3 lives.

We have received your query with regards to your various queries, our response is as follows:

1) Jumu῾ah Salaah is Fardh-e-῾ayn (obligatory). It is one of the most salient features of Islam. It is not permissible for any Muslim to leave out Jumu’ah intentionally. A person who does not attend Jumu῾ah Salaah, but rather prays Zhuhr Salaah by himself, without any valid excuse, is a Faasiq (sinner). Regarding the virtue and importance of Jumu’ah Salaah, Rasulullāh sallallāhu ῾alayhi wasallam said:

“The person who takes a bath on Friday and goes early to the masjid, listens to the Khutbah attentively and does not engage in futile acts while the Khutbah is being delivered, will get the reward of one year ῾ibadah, one year fasting and one year Salaah, for every step that he takes.”

 On the other hand, severe warnings have been mentioned regarding the person who misses Jumu῾ah Salaah without any valid excuse.

وَحَدَّثَنِى الْحَسَنُ بْنُ عَلِىٍّ الْحُلْوَانِىُّ حَدَّثَنَا أَبُو تَوْبَةَ حَدَّثَنَا مُعَاوِيَةُ – وَهُوَ ابْنُ سَلاَّمٍ – عَنْ زَيْدٍ – يَعْنِى أَخَاهُ – أَنَّهُ سَمِعَ أَبَا سَلاَّمٍ قَالَ حَدَّثَنِى الْحَكَمُ بْنُ مِينَاءَ أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ وَأَبَا هُرَيْرَةَ حَدَّثَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللَّهِ -صلى الله عليه وسلم- يَقُولُ عَلَى أَعْوَادِ مِنْبَرِهِ:  لَيَنْتَهِيَنَّ أَقْوَامٌ عَنْ وَدْعِهِمُ الْجُمُعَاتِ أَوْ لَيَخْتِمَنَّ اللَّهُ عَلَى قُلُوبِهِمْ ثُمَّ لَيَكُونُنَّ مِنَ الْغَافِلِين

 Hadhrat Ibn Umar and Abū Hurairah radiyallahu ῾anhuma narrate that they heard Rasulullah Sallallahu alayhi wasallam saying: “People should abstain from leaving out Jumu῾ah salāh. If not, Allah Ta῾āla will put a seal over their hearts whereby they will fall into severe negligence and ignorance.”

وعن ابن عباس أن النبي صلى الله عليه وسلم قال : (” من ترك الجمعة من غير ضرورة كُتب منافقا في كتاب لا يمحى ولا يبدل ” . وفي بعض الروايات ثلاثا ) .   رواه الشافعي والبيهقى فى المعرفة

 It has been mentioned on the authority of Hazrat Ibn Abbas (Radhiyallahu Anhu) that Nabi (Sallallahu Alaihi Wasallam) said:

“The person who leaves Jumu῾ah Salaah without any valid reason will be written a Munaafiq (hypocrite) in a book that will not be erased nor changed (unless the person repents), and in some narrations, if he leaves out 3 Jumu’ah Salaahs.

عن جابر بن عبد الله قال خطبنا رسول الله صلى الله عليه وسلم فقال (… أن الله قد افترض عليكم الجمعة فى مقامي هذا فى يومي هذا فى شهري هذا من عامي هذا إلى يوم القيامة فمن تركها فى حياتي أو بعدي وله إمام عادل أو جائر استخفافا بها أو جحودا بها فلا جمع الله له شمله ولا بارك له فى أمره ألا ولا صلاة له ولا زكاة له ولا حج له ولا صوم له ولا بر له حتى يتوب فمن تاب تاب الله عليه

 It has been reported on the authority of Jaabir (Radhiyallahu Anhu) that Rasulullah (Sallallahu Alaihi Wasallam) said, “…Verily Allah Ta’ala has made Jumu’ah obligatory upon you, as I stand here on this day in this month of this year, till the day of Qiyamah. The one who leaves out Jumu῾ah Salaah during my lifetime or after I have left this world, whether he has a just or an unjust ruler, taking this commandment lightly or not accepting this commandment, then may Allah create difficulty and disunity for him, and may he have misfortune in all his doings. Verily no Salaah of his will be accepted, no Zakaat of his will be accepted, no Hajj of his will be accepted, no fasting of his will be accepted and no good deed of his will be accepted until he repents. And Allah Ta’ala forgives the one who seeks his forgiveness…”.

عَنْ أَبِي الْجَعْدِ الضَّمْرِيِّ وَكَانَتْ لَهُ صُحْبَةٌ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: ( مَنْ تَرَكَ ثَلَاثَ جُمَعٍ تَهَاوُنًا بِهَا طَبَعَ اللَّهُ عَلَى قَلْبِه )

رَوَاهُ َأَبُو دَاوُد وَالتِّرْمِذِيُّ وَالنَّسَائِيُّ

It has been reported on the authority of Abul Ja’ad Ad-dhamri (Radhiyallahu Anhu) that Nabi (Sallallahu Alaihi Wasallam) said, “Allah Ta’ala seals the heart of that person who misses out three Jumu’ahs due to negligence.

There is no doubt that it is a grave sin to leave out Jumu’ah intentionally, but still we do not say that it will be considered apostasy, unless the person does not believe it to be an essential part of Deen or he makes a mockery of it (may Allah forbid!). However, no true Muslim will ever intentionally neglect his Jumu῾ah Salaah, considering the severity of the warnings mentioned in the Ahadeeth.

Therefore, it is necessary (if the conditions of the necessity of Jumuah are found) that those Muslims working at the abattoir be given the permission to perform their Jumuah Salaah.

وَاعْلَمْ أَوَّلًا أَنَّ الْجُمُعَةَ فَرِيضَةٌ مَحْكَمَةٌ بِالْكِتَابِ وَالسُّنَّةِ وَالْإِجْمَاعِ ، يُكَفَّرُ جَاحِدُهَا ، قَالَ تَعَالَى { إذَا نُودِيَ لِلصَّلَاةِ مِنْ يَوْمِ الْجُمُعَةِ فَاسْعَوْا إلَى ذِكْرِ اللَّهِ } رَتَّبَ الْأَمْرَ بِالسَّعْيِ لِلذِّكْرِ عَلَى النِّدَاءِ لِلصَّلَاةِ ، فَالظَّاهِرُ أَنَّ الْمُرَادَ بِالذِّكْر الصَّلَاةُ ، وَيَجُوزُ كَوْنُ الْمُرَادِ بِهِ الْخُطْبَةَ ، وَعَلَى كُلِّ تَقْدِيرٍ يُفِيدُ افْتِرَاضَ الْجُمُعَةِ

(فتح القدير-  ج:3   ص:197 )

وَإِنْ تَرَكَ الْجُمُعَةَ ثَلَاثَ مَرَّاتٍ يَصِيرُ فَاسِقًا كَذَا ذُكِرَ في بَعْضِ الْمَوَاضِعِ وَبِهِ أَخَذَ شَمْسُ الْأَئِمَّةِ السَّرَخْسِيُّ وَذَكَرَ في بَعْضِ الْمَوَاضِعِ أَنَّهُ يُبْطِلُ الْعَدَالَةَ ولم يُقَدِّرْ ولم يذكر الْعَدَدَ وقال شَمْسُ الْأَئِمَّةِ الْحَلْوَانِيُّ رَحِمَهُ اللَّهُ تَعَالَى وَعَلَيْهِ الْفَتْوَى وَهَذَا إذَا تَرَكَهَا مَجَانَةً وَرَغْبَةً عنها من غَيْرِ عُذْرٍ كَذَا في فَتَاوَى قَاضِيخان     

 ( الفتاوى الهندية-  ج:3  ص:466 )

سوال: ہم نے سنا ہے کہ جس شخس نے جان بوجھ  کر تین جمعہ ترک کردۓ وہ کفر میں داخل ہو گیا ، اور  وہ  نئےسرے سے کلمہ پڑھے ، کیا  یہ حدیٹ صحیح ہے ؟

جواب: حدیٹ کے جو  الفاظ آپ نے نقل کئے ہیں وہ تو مجھے نہیں ملے، البتہ اس مضمون کی متعدد احادیٹ مروی ہیں:

1- {مَنْ تَرَكَ ثَلَاثَ جُمَعٍ تَهَاوُنًا بِهَا طَبَعَ اللَّهُ عَلَى قَلْبِهِ}

(رَوَاهُ أَبُو دَاوُد وَالتِّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ ماجه-  مشكوة  ص:121)

2-{ لَيَنْتَهِيَنَّ أَقْوَامٌ عَنْ وَدْعِهِمْ الْجُمُعَاتِ أَوْ لَيَخْتِمَنَّ اللَّهُ عَلَى قُلُوبِهِمْ ثُمَّ لَيَكُونُنَّ مِنْ الْغَافِلِينَ }

(رواه مسلم- مشكوة  ص:121)

3-{من ترك الجمعة من غير ضرورة كتب منافقا في كتاب لا يمحى ولا يبدل}

( رواه الشافعي- مشكوة  ص:121)

4- { مَنْ تَرَكَ الْجُمُعَةَ ثَلَاثَ جُمَعٍ مُتَوَالِيَاتٍ فَقَدْ نَبَذَ الْإِسْلَامَ وَرَاءَ ظَهْرِهِ }

(رواه أبو يعلى- مجمع الزوائد  ج:2  ص:193 )

ان احادیٹ سے معلوم ہوا کہ جمعہ کا ترک کر دینا بد ترین گناہ کبیرہ ہے،جسکی وجہ سے دل پر مہر لگ جاتی ہے، قلب ماؤف ہو جاتا ہے،اور اس میں خیر قبول کرنے کی صلاحیت نہیں رہتی،ایسے شحص کا شماراللہ تعالی کے دفتر میں منافقوں میں ہوتا ہے،کہ ظاہر میں تو مسلمان ہے مگر قلب ایمان کی حلاوت اور شیرینی سے محروم ہے، ایسےشخص کو اس گناہ کبیرہ سے توبہ کرنی چاہئےاورحق تعالی شانہ  سے صدق دل سے معافی مانگنی چاہئے  ۔

2) It is necessary to take the name of Allah Ta’ala at the time of slaughtering. Allah Ta’ala states in the Noble Qur’an

“Do not eat anything over which the name of Allah has not been mentioned. To do so is abomination…” 

(Qur’an 6:121)

In this Aayat it is quite clear that the Tasmiyah (name of Allah Ta’ala) needs to be recited on every single animal being slaughtered. Together with this, the animal needs to be slaughtered by hand. Therefore, if it is omitted intentionally or mechanically slaughtered then the animal will be Haraam

3) With regards to your question with regard to blood transfusion, we reproduce below an extract from a previous Fatwa of Madrasah Arabia Islamia Azaadville with regards to a similar situation:  

“The ruling with regards to blood donation and transfusion requires a brief explanation. 

The fundamental ruling with regards to blood donation and transfusion is that it ought not to be permissible unless in situations of real and extreme necessity. By extreme necessity it is meant that a patient would (in the view of a medical expert) lose his life if he were not given a blood transfusion and that there was no other alternative or substitute for treating his particular ailment. Hence, according to the dictates of the above mentioned principle, the ruling with regards to donating blood would be that if there is a patient on the throes of death and the doctors say that there is strong hope that a transfusion would save the patient’s life and an urgent appeal for donation is made at the spur of the moment, then one would be permitted to donate blood, otherwise not. 

However, in view of the challenges facing the medical fraternity in this time and era this ruling (with regards to blood donation) in its essence is not applicable due to the fact that there are stringent regulations that have to be adhered to before a donor’s blood can be considered suitable for transfusion into a recipient such as screening the donor’s blood for diseases such as HIV, etc it would thus be difficult to get suitable blood on the spur of the moment. 

Based on the aforementioned we respond to your query by saying that, one is allowed to donate blood whenever the call for donations is made, even though there may not be (at that specific moment) an urgent appeal made for a patient who is on the throes of death. The donor, however, should donate his/her blood with the intention that the blood must be used in times of extreme necessity for someone who is in dire need of it.

There are two reasons for the permissibility of blood transfusion in spite of it constituting the usage the human body parts, whereas it has just been mentioned that organ transplants are not permissible for the very same reason. The reasons for the permissibility of blood transfusion in life-threatening situations are as follows: Firstly, there is hardly any pain felt when removing blood from the body, contrary to that of removing the limb. 

Secondly, the jurists have given it the same law as the drinking of a woman’s milk. It is permissible for a baby to drink the milk of a woman. Milk is produced from blood. So just as it is permissible to drink the milk, it is permissible to use the blood of another person (in dire necessity).”

With regards to the issue of receiving gifts from the company,  you may accept the gifts granted to you as they are an occasional and unconditional kind gesture rendered by the organization rather than a conditional remuneration.
