Question

(#059)

Subject: Jewellery
Full Description of Question:
Assalamoalaikum Warahmatullah

1. My wife has been given a Platinum ring and Bracelet which has diamonds and
a small amount of gold on it. Is she allowed to wear this.

2. She also has a platinum ring with diamonds but no gold. Is she allowed to
wear this.

Subject: Travelling & Salaah
Full Description of Question:
I travel overseas often on business. Some of my companions join their Salaat
during the travels. What is the ruling in regards to joining Dhur and Asr
Salaat and Maghrib and Eisha Salaat during my travels. The joining would be
convenient and in some instances would save me having to delay a particular
salaat due to the circumstances of my travel, for example travelling at night
on my own in strange territory by car in the US, there are safety issues. Is
this joining allowable under the Hanafi Fiqh and if done so would my salaat
be valid.
Jazakumullah khair

We received your query regarding the wearing of platinum jewellery and the ruling of joining two Salaats whilst in a journey.

Our response is as follows:

Shariah has permitted women to adorn themselves within the boundaries of their homes. Islam has given this special permission only to women in order that they use the various means of adornment in order to please their spouses. Among the various means of adorning oneself, is the usage of jewellery and rings.

Women are without doubt allowed to wear rings made from gold and silver. However, to wear rings made from other substances such as metal, wood, platinum etc is impermissible, even for women.

However, it should be mentioned here that consideration is taken of the ring itself and not the stone, as mentioned in Durrul Mukhtaar 6/360.

Furthermore, it is permissible for females to adorn themselves with other jewellery (such as bangles, bracelets, necklaces, etc.) made from platinum, or for that matter, any permissible substance, whether it be silver, gold, or even imitation jewellery.

2) In terms of the Hanafi Maz-hab, it is not permissible to join ones Zuhr and Asr, and ones Maghrib and Isha due to the following Aayat:

{إِنَّ الصَّلوٰةَ  كَانَتْ عَلَى الْمُؤْمِنِيْنَ كِتَابًا مَّوْقُوْتًا}

Verily Salaah has its appointed time upon the believers

Furthermore, the following Hadeeth narrated by Abdullah Ibn Mas’ud radiyallahu anhu also mentions the impermissibility of joining ones Salaah :

عن عبد الله  قال ما رأيت رسول الله  صلى صلاة إلا لميقاتها إلا صلاتين صلاة المغرب و العشاء بجمع وصلى الفجر يومئذ قبل ميقاتها

رواه الشيخان

(آثار السنن 277)

Hazrat Abdullah Ibn Mas’ud radiyallahu anhu said: I never saw Rasulullah Sallallahu alai wa Sallam performing Salaah unless it was in its proper time, besides the Salaah of Magrib and Isha in Muzdalifah (at the occasion of Hajj) and he performed the Salaah of Fajr (also in Muzdalifah) before its usual time. (Bukhari & Muslim)

عن عبد الله  قال كان رسول الله  يصلي الصلاة لوقتها إلا بجمع و عرفات

رواه النسائي و اسناده صحيح

(آثار السنن 274)

Hazrat Abdullah Ibn Mas’ud radiyallahu anhu narrates that Rasulullah Sallallahu alai wa Sallam used to perform Salaah in its proper time, except in Muzdalifah and Arafat (at the occasion of Hajj). (Nasaai)

And regarding the Hadeeth narrated by Muslim and Tirmizi, Allama Zafar Ahmad Uthmani rahimahullah mentions:

“The Hadeeth narrated by Muslim from Hadrat Ibn Abbas radiyallahu anhuma is interpreted as Jam’e Soori (which means to delay one Salaah until just before the next Salaah time begins, then to perform that particular Salaah at its last possible time and after the time of the next Salaah starts, to perform that Salaah, at the beginning of its time; (meaning that each Salaah was performed in its time) and to interpret it as Jam’e Haqeeqi (which means to perform one Salaah in another Salaah’s time) is contrary to the consensus of the Fuqaha. Imaam Tirmizi himself has stated: All the narrations in this book are practised upon in some way and is the opinion of some scholars or the other besides two riwaayats, one of them is the Hadeeth of Hadrat Ibn Abbas radiyallahu anhuma.”

Allama Zafar Ahmad Uthmani rahimahullah concludes:

“The apparent meaning of this Hadeeth has been unanimously discarded. None of the scholars was of this opinion.”

(I’laaus Sunan vol. 2 pg: 95 & 96)

Therefore, it is necessary for you to read your Salaah in the appropriate times; and to join two Salaats in one time is a grave sin. We advise that you plan your business travels in such a way that you are able to perform your Salaah in the Masjid with Jamaat, and if for some reason you are faced with a predicament that there is no Masjid around and there is a fear that you will miss your Salaat and you are genuinely worried about your safety then you may perform your Maghrib Salaah in its correct time i.e after shafaq-e-Ahmar (the redness of the sky has disappeared) just prior to the entering of the time of Esha and thereafter you will wait for a while until the time for Esha enters i.e after shafaq-e-abyadh (the whiteness of the sky has disappeared) and you will then read you Esha in its correct time. In this way you will still be performing your Salaah on their correct time.
