Second Jamaat in the Masjid

Question

Assalaamu Alaikum Mufti  sahib. Enquiring a masla…..What should i do if i reach the masjid and find the jamaath salaath is over? What is shariah rulings in regards to making another jamaath if more brothers join?

We have received your query dated 24/07/2022, our response is as follows:

It is Makrooh to perform a second Jamaat in the actual Masjid area after the first Jamaat has been performed. It is narrated in a Hadeeth that Nabi {sallallahu alaihi wasallam} once went to make peace between the Ansaar {radhiallahu anhum}.  When he returned, Nabi {sallallahu alaihi wasallam} found that the Salaat with Jamaat had been already performed, so he turned back to his house and performed Salaat with Jamaat with his family. ( Shami  vol 1 pg. 395 )

If it was not Makrooh, Nabi { sallallahu alaihi wasallam } would have performed the second Jamaat in the Masjid. However if you intend to perform Salaat with Jamaat (after missing the first Jamaat), you should perform the second Jamaat outside the boundary of the Masjid. It could be performed in a Musallah or any other place besides the Masjid. However, a habit of this practice should not be formed even out of the Masjid boundary, as this could lead to disregard for the importance of the first Jamaat.^[1]

قوله وتكرار الجماعة   لما روى عبد الرحمان بن ابى بكر عن ابيه ان رسول الله صلى الله عليه وسلم خرج من بيته ليصلح بين النصار فرجع وقد صلى في المسجد بجماعة   فدخل رسول الله صلى الله عليه وسلم في منزل بعض اهله فجمع اهله فصلى بهم جماعة

ولو لم يكره تكرار الجماعة في المسجد لصلى فيه    وروى عن انس رضى الله عنه ان اصاب رسول الله صلى الله عليه وسلم كانوا إذا فاتتهم الجماعة صلوا في المسجد فرادى   ولان التكرار يؤدي الى تقليل الجماعة لان الناس إذا علموا انهم تفوتهم الجماعة يتعجلون فتكثر والا تأخروا
