Question
Salam alaykum, I have seen charities advertising that Zakat money can be used for building Water Wells, is this allowed? Similarly can Zakat money be used for the maintenance of a Water Well? Jazakallah Kheir

We have received your query regarding the usage of Zakaat monies for water wells, our response is as follows:
It is impermissible to use Zakaat monies for the construction and maintenance of water wells. [1][2]
Zakaat will only be discharged if it is given to such people who the Shariah regard as worthy and eligible recipients, thereafter they may utilise the funds in whichever avenue they deem fit.

[1] سوال[۴۷۰۷] : ایک مدرسہ اسلامیہ مقروض ہے اور چندہ کے پیسہ سے چلتا ہے، اس کی مالی حالت بہت کمزور ہے، کیا زکوۃ کے پیسے سے مدرسہ کا قرضہ ادا کیا جا سکتا ہے جبکہ مدرسہ میں کوئی طالب علم یتیم نہیں ہے؟ مدرسہ بہت قرض دار ہے۔
الجواب حامدا ومصلياً:
زکوۃ ادا ہونے کے لئے ضروری ہے کہ کسی غریب مستحق کو اس کا مالک بنادیا جائے (۱)، پس جو پیسہ مدرسہ میں زکوٰۃ کا دیا گیا ہے، اگر براہ راست اس سے مدرسہ کا قرض ادا کر دیا جائے گا تو زکوۃ ادا نہیں ہوگی ،اس کا ضمان لازم ہوگا۔
نوٹ: زکوة کا پیسہ براہ راست تنخواہ تعمیر مں خرچ کرنا بھی جائز نہیں (۲) ۔ فقط واللہ تعالی اعلم بالصواب.
