Tafweedh-ut-Talaaq

Question

(#240)

Assalamu’alaikum Wa Rahmatullahi Wa Barakatuhu. In islam there is a concept of man delegating the power to end the marriage to his wife. What I have learned various schools have different interpretations regarding it’s validity one school like the Hanafi allow the man to delegate the power permenantly while the other schoolm like Shafai only allow it for a certain time period like 2 or 7 years and so on.

Can you tell me which interpretation is more correct according to Quran and Sunnah

We have received your query regarding Tafweedh Talaaq, our response is as follows:

According to the Hanafi Mazhab a man can delegate the authority of issuing a Talaaq to his wife. This ruling has been derived by Shar’ee proofs just like the other rulings of the Hanafi Mazhab.

One should strictly adhere to one Mazhab, in this lies the safety of ones Deen. Please refer to the articles section on the Darul Ifta website to find out more relating to this topic.

Please contact the Darul Ifta if you have any specific queries relating to Tafweedh Talaaq (delegation of the divorce to one’s wife).

And Allah Ta’ala knows best
