Question
As Salaam Mu Alaikum I would like to enquire below Person is in a medical profession and books appointment in advance ( Months or weeks) for consults. Upon booking it is stated that if the booking is cancelled within 24 hours of the consult the full session fee will be due. Is the process halal and can the professional charge for the cancellation within the 24 hour period as the professional could have booked another patient at that time but its to late to rebook another patient in 24 hours so it will be a loss of revenue for the time. Please advise Jazakallah

We have received your query regarding cancellation fees, our response is as follows:
It is not permissible to charge a cancellation fee in the case wherein a patient cancels an appointment. However, if an admin fee is required for admin work i.e. paper work, forms, administration work etc, then it will be permissible to charge a admin/registration fee at the time of making the appointment. This admin fee will need to be a fixed amount and will not change, irrespective of the time of the cancellation. [1]

[1] باب فسخ الإجارة…. (وَلُزُومِ ضَرَرٍ لَمْ يَسْتَحِقَّ بِالْعَقْدِ إنْ بَقِيَ) أَيْ الْعَقْدُ (كَمَا فِي سُكُونِ وَجَعِ ضِرْسٍ اُسْتُؤْجِرَ) حَدَّادٌ (لِقَلْعِهِ)، فَإِنَّ الْعَقْدَ إنْ بَقِيَ لَزِمَ قَلْعُ سِنٍّ صَحِيحٍ وَهُوَ غَيْرُ مُسْتَحَقٍّ بِالْعَقْدِ (وَمَوْتِ عُرْسٍ أَوْ اخْتِلَاعِهَا اُسْتُؤْجِرَ) أَيْ طَبَّاخٌ (لِطَبْخِ وَلِيمَتِهَا)، فَإِنَّ الْعَقْدَ إنْ بَقِيَ تَضَرَّرَ الْمُسْتَأْجِرُ بِإِتْلَافِ مَالِهِ فِي غَيْرِ الْوَلِيمَةِ

(المادة ٤٦٩): تلزم الأجرة باستيفاء المنفعة مثلا لو استأجر أحد دابة على ان يركبها الى محل ثم ركبها ووصل الى ذلك المحل يستحق آجرها الأجرة

(المادة ٤٦٦): لا تلزم الأجرة بالعقد المطلق يعنى لا يلزم تسليم بدل الاجارة بمجرد انعقادها حالا

داخلہ فیس کا حکم
